Lawsuit Update: Pfizer Tacitly Admits Lying, Fraud, Breach of Contract
Attorney dismantles oral arguments in Brook Jackson False Clams Act case
Today, March 3rd, 2023, attorney Robert Barnes discussed the hearing that took place on March 1st in Beaumont, TX, in the UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF TEXAS, where the court heard the defendants’ motions to dismiss in the civil suit brought by Brook Jackson.
Initiated by a complaint filed with the FDA by Jackson, a former Pfizer clinical trial monitor, the lawsuit was filed on January 8, 2021 pursuant to the False Claims Act (31 USC §§ 3729-3732) on behalf of Jackson and the United States against VENTAVIA RESEARCH GROUP, LLC, PFIZER, INC., AND ICON, PLC. The complaint alleges that the defendants created bogus clinical trials, produced fake data, covered-up the adverse events of the trials, and presented false claims in order to defraud the Defense Department, allowing them to collect the contract payments.
In today’s oral argument effort to get the case dismissed, the defendants argued that, even if Pfizer did create a gene therapy which does not meet the definition of “vaccine” per the D.O.D. contract, and even if the injections do not prevent COVID, as required by the contract, and even if the shots and boosters induced COVID-19 infections, and even if the shots were not approved by the FDA as safe and effective, as required by the contract, and even if the clinical trials were fraudulent, and even if the invoices were bogus, the defendants and their profits should be protected by the PREP Act.
